CLARIFICATION TEXT AS PER THE LAW NR. 6698 ON PROTECTION OF PERSONAL DATA
This
clarification text, in the capacity of data controller of ZEKERİYAKÖY ATB
EĞİTİM HİZMETLERİ TİCARET LİMİTED ŞİRKETİ (hereinafter referred to as “Data
Controller” or “Company”), fulfills the obligation of disclosure within the
scope of Article 10 of the Law on Protection of Personal Data No. 6698 (“Law”).

B- PROCESSED PERSONAL DATA
Personal Data in the Law; It is
defined as “any information relating to an identified or identifiable natural
person”. Personal Data collected and/or processed within the scope of education
and training services offered by ZEKERİYAKÖY ATB EĞİTİM HİZMETLERİ TİCARET
LİMİTED ŞİRKETİ; Name, surname, signature, passport photo of our students,
teachers, board of trustees and board of directors, staff, parents/guardians of
our students, subcontractors, suppliers and their workers, T.R. ID number, T.C.
Information on the identity card/information in the identity card, passport
information for foreign nationals, address information, phone numbers, etc.
with information; student numbers, primary education information, primary
education diploma information, bank and bank account information regarding
payment of school fees, bank payment information, bank payment receipts, grades
received by the student throughout their education life at school, projects and
assignments they made, presentations, club activities and social , artistic

C- GENERAL PRINCIPLES ON THE
PROCESSING OF PERSONAL DATA
Personal data is processed by our
company, which has the title of data controller, within the framework of the
principles listed below, which are regulated by Article 4 of the Law on the
Protection of Personal Data No. 6698:
- Processing for current, specific,
clear and legitimate purposes when necessary,
- Compliance with the law and
honesty rules,
- Being connected, limited and
restrained with the purpose for which they are processed,
- To be stored for the period
required for the purpose for which they are processed or stipulated in the
relevant legislation.
D- PURPOSE OF PROCESSING THE DATA
In accordance with Articles 5 and 6
of the Law on the Protection of Personal Data, the personal data to be
collected or processed to date must be processed both in the legal regulation
and for the following or similar purposes:
a. Student and Legal Representative
Data:
For the realization of student
registration, the name and surname of the students, T.C. Necessary information
such as identity number, passport number for foreign nationals, contact
information, photo are taken and recorded. Name and surname of the legal
representatives of the students, T.C. Necessary information such as identity
number, passport number for foreign nationals, contact information, bank
account information, and the name and identity information of other children
are obtained and recorded in order to provide discounts.
b. Fingerprint and Camera Data:
Audio and/or video recording via
security cameras in order to ensure the security of institutions and students,
to control the entrances and exits to buildings and facilities, to increase
personnel efficiency and to determine working conditions, to prove the business
relationship, to prove possible faulty transactions by means of camera images,
and to reduce the intensity of entry-exit hours. and fingerprints are taken.
Our company allows people who do not want to share their fingerprints at the
entrance to our institutions, as an alternative, the opportunity to enter with
a card. In order to benefit from this right, it is sufficient and necessary to
apply to our company with a written and signed petition together with the
documents identifying your identity.
c. Visitor Data:
For security purposes, the name,
surname, T.C. of the visitors coming to our institutions and campuses.
ID/passport/driver's license number, entry-exit times and who they will contact
information are collected and recorded.
D. Company Personnel Data:
Evaluation of job applicants,
invitation to job interviews, creation of personal file, fulfillment of other
legal obligations determined by Labor Law No. 4857, Social Insurance and
General Health Insurance Law No. 5510, Turkish Code of Obligations No. 6098,
Turkish Commercial Code No. 6102 and other legislation is taken in order for
the company to prove its business relationship with the relevant personnel and
to use its rights of claim and defense effectively in a possible judicial
process.
Data Received in the Scope of
Service and/or Commercial Business Relationship:
Our school's purchase of goods and
services with third parties, leasing, etc. Name-surname of the parties,
representatives, personnel and related parties within the scope of commercial
business relationship, T.C. Necessary professional information such as identity
number, passport number, circular of signature, contact information, title /
division of labor, qualification certificate, professional chamber information
and financial information such as account number are taken for the purpose of
proving contracts and ensuring mutual assurance of services.

necessary personnel and health institutions for students with allergies or
diseases that need to be followed, taking and using photographs of students so
that they can be easily identified in an emergency,
- Transmitting information to the
data owner on the subjects requested and responding to his/her complaints and
notifications, etc. processes your personal data for purposes.
F- COLLECTION, PROCESSING AND
TRANSFER OF PERSONAL DATA
Your personal data can be collected
automatically and automatically through all campuses and affiliated business
units of our institution, our website, social media accounts, integration
systems, parties from which our school receives services that are complementary
or extensions of its activities, contracted organizations, business partners,
suppliers and similar means. may be collected orally, in writing or
electronically by non-automatic means.
The Company will be able to share
your personal data with teachers, trainers, financial advisors,
subcontractors/suppliers from whom it supplies services and goods, companies
that prepare, process and maintain the Company's software, legally authorized public
institutions and private individuals, and organizations that organize the exam
within the scope of the exams applied by students. , will also be able to
transfer some statistical information abroad by anonymizing it. Confidentiality
agreements are made with real and legal persons for all transferred and shared
data, and the most sensitive work is done with software companies for data
security.
Labor Law, Tax Law etc. Your
personal data, which is within the scope of the legislation of the Ministry of
National Education together with the legislation and should be kept
indefinitely, will be kept by the company indefinitely. All your personal data,
except those that need to be kept indefinitely, will be destroyed within 1
(one) year following the termination of your communication with our
institution.
Pursuant to Article 5 of the KVKK,
the Company may process your personal data, which it has received in accordance
with the law, without your explicit consent, in the following cases:
• In cases where it is expressly
stipulated in the laws,
• If you, as the data owner, are
unable to express your consent due to actual impossibility, or in cases where
your consent is not legally valid, it is necessary to process your personal
data in order to protect your or someone else's life or physical integrity,
• It is necessary to process the
personal data of the parties to the contract, provided that it is directly
related to the establishment or performance of a contract you have concluded
with ZEKERİYAKÖY ATB EĞİTİM HİZMETLERİ TİCARET LİMİTED ŞİRKETİ and its related
companies/organizations,
• It is compulsory for the company
to fulfill a legal obligation,
• Your personal data has been made
public by you,
• Data processing is mandatory for
the establishment, exercise or protection of a right, and
• Data processing is mandatory for
the Company's legitimate interests, provided that it does not harm your
fundamental rights and freedoms.
G- RIGHTS OF PERSONS whose data is
processed
Pursuant to Article 11 of Law No.
6698;
“Everyone, by applying to the data
controller;
a) Learning whether personal data is
processed or not,
b) If personal data has been
processed, requesting information about it,
c) Learning the purpose of
processing personal data and whether they are used in accordance with its
purpose,
ç) To know the third parties to whom
personal data is transferred in the country or abroad,
d) Requesting correction of personal
data in case of incomplete or incorrect processing,
e) Requesting the deletion or
destruction of personal data within the framework of the conditions stipulated
in Article 7,
f) Requesting notification of the
transactions made pursuant to subparagraphs (d) and (e) to third parties to
whom personal data has been transferred,
g) Objecting to the emergence of a
result against the person himself by analyzing the processed data exclusively
through automated systems,
ğ) To request the compensation of the damage in case of loss due to unlawful processing of personal data,has rights.
British School Istanbul will
finalize your request free of charge as soon as possible and within 30 (thirty)
days at the latest, depending on the nature of the request. Your requests,
including your explanations regarding your right to exercise the rights
specified in Article 11 of the Personal Data Protection Law, together with the
necessary documents identifying your identity, with a written and signed
petition, to Uskumruköy Mah. Kilyos Cad. You can deliver it to A No.238/1
Interior Door No.3 Sarıyer/Istanbul in person, or send it via a notary public
or by registered letter with return receipt requested.
